What is a defective product liability claim?

If you’ve been injured or harmed by a product you used you may have a products liability claim for a defective product. While state laws can vary in the particulars of what you must show, products liability law generally requires that you prove all of the following “elements” in your claim in order to prevail and recover for your injury:

  • You were injured or suffered losses (physical injuries or monetary/property loss);
  • The product is defective (manufacturing error, design defect, or failure to warn);
  • The defect caused your injury; and
  • You were using the product as it was intended.
